Terms of sale
1. Preamble
These General Terms and Conditions of Sale (GTCS) apply exclusively to the sale of paintings created by Maeva J. and offered on the Shopify website (https://maeva-j.com). These GTCS supplement the General Terms of Use for the Shopify platform.
2. Products
- Paintings: The paintings for sale are original works subject to copyright and intellectual property laws; they are accompanied by a certificate of authenticity.
- Art Prints: Art prints are reproductions of original works and are subject to copyright and intellectual property laws.
Photographs of the works displayed on the website are non-contractual and may exhibit variations in color or appearance due to screen settings or the lighting used in the images.
3. Orders
Orders are placed directly via the Shopify platform.
By placing an order, the buyer fully and unreservedly accepts these GTCS.
4. Pricing
Product prices are listed in euros (€) and are fixed.
Applicable shipping costs are displayed at the time of ordering, once the shipping address has been entered.
Prices are subject to change at any time; however, the price applied will be the one in effect at the time the order is placed.
5. Payments
Accepted payment methods include:
PayPal: for secure payment via credit/debit card or a PayPal account.
Credit/Debit Card: Visa, MasterCard, American Express, CB, Maestro.
Orders are only confirmed once full payment has been received.
6. Delivery
Shipping by Maeva J.:
For deliveries within France: paintings are carefully packaged and shipped via carrier to the address provided at the time of ordering. Delivery takes 2 to 4 business days and is provided free of charge. For delivery within Europe, please contact Maeva J. to obtain a shipping quote.
Shipping via WhiteWall (print laboratory):
Shipping costs and delivery times are managed by WhiteWall and will be specified before you confirm your order.
Any claims regarding damage incurred during transit must be reported to both the carrier and Maeva J. within 48 hours.
7. Right of Withdrawal
In accordance with applicable legislation, the Customer has 14 days from the date of receipt to exercise their right of withdrawal.
Return shipping costs are the responsibility of the buyer.
Returned artworks must be in their original condition and in their original packaging. Any damaged artwork will not be refunded.
8. Warranty
The paintings are covered by the legal guarantee of conformity and the warranty against hidden defects.
In the event of a proven defect, the Customer may request a refund or an exchange.
9. Intellectual Property
The artworks and their content remain the exclusive intellectual property of Maeva J.
Any unauthorized reproduction or use is strictly prohibited and will be subject to legal action.
10. Personal Data
Data collected for the processing of orders is used in strict compliance with applicable legislation.
In accordance with the French Data Protection Act ("Informatique et Libertés"), the Customer has the right to access, modify, or delete their personal data upon simple request via the contact form on the website.
11. Disputes
These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the parties shall endeavor to reach an amicable resolution. Failing this, the matter shall be referred to the competent courts.
